休息三分钟就要被公司开除,这样的事情听起来匪夷所思,但居然是真的!
广州一店长因休息3分钟被开除
2021年3月,余某入职品某公司任店长,负责管理该公司位于某广场的门店。2024年9月26日,品某公司区域经理通过微信告知余某,其工号将于当日作废。双方均确认劳动关系于当日解除。
A store manager in Guangzhou, Guangdong province, was fired for taking a three-minute rest break, with the court ruling that the company must pay compensation. Yu joined a Company as a store manager in March 2021. On Sept 26, 2024, the company's regional manager notified Yu via WeChat that his employment was terminated.
公司主张,余某在工作时间、店内有顾客时坐于收银台凳子上睡觉,被商场人员投诉;其管理的门店曾在营业时间关闭店门,违反商场制度,导致公司无法继续租赁该场地,产生严重损失,故解除劳动合同合法。
余某表示,2024年9月某日被商场人员投诉一事确实存在,但其从9时30分开始上班至当日22时30分下班,当天门店所有工作均由其一人完成。20时许,当天上班已超8小时,出现生理性疲惫,因为工作太累,坐在凳子上歇了一会,实际没有睡着。且品某公司也无证据证明自己没有接待客人,客人进来时自己有接待,只是太累就坐了一下,闭眼休息了3分钟而已。至于2024年8月某日闭店一事,系因当日店内仅一名店员,其上厕所期间短暂关门。
The company claimed Yu was fired legitimately due to two incidents: first, he allegedly slept at the cashier's desk during business hours while customers were present, leading to a complaint from mall staff; second, his store temporarily closed during operating hours, violating mall regulations and causing significant financial losses by jeopardizing the company's lease.
Yu acknowledged the September 2024 complaint but explained he had worked alone for 13 hours (9:30 am to 10:30 pm) that day. Around 8 pm, physically exhausted after over eight hours of work, he sat on a stool with his eyes closed for three minutes but did not sleep. Regarding the August 2024 store closure, Yu said it occurred when the sole staff member used the restroom.
公司被判赔近5万元
据报道,广州市南沙区人民法院一审判决,品某公司向余某支付工资差额217.2元、住房补贴3000元、违法解除劳动合同赔偿金49572.24元,驳回公司全部诉讼请求,判决已生效。
The Nansha District People's Court in Guangzhou ruled that the company must pay Yu 217.2 yuan in back wages, 3,000 yuan in housing subsidies, and 49,572.24 yuan in compensation for unlawful termination.

法官表示,余某连续工作超8小时,公司未安排人员顶岗,其疲惫时闭眼休息是正常生理现象,现有证据无法证明其长时间睡眠及影响销售。8月某日闭店是因上厕所,余某已作出合理解释。
品某公司虽提供了视频,但该时长为2秒的视频仅显示余某手扶着头闭着眼靠在背板上,不足以证明余某处于长时间睡眠状态,也未能显示影响门店正常的销售工作和造成直接经济损失。
法官指出,余某行为并非严重过错,公司无证据证明其行为造成责罚规定中的“严重损失”,解除合同缺乏事实及法律依据,属违法解除。
法官提示,休息权是劳动者基本权利,企业应维护劳动者休息权,助力自身高质量发展。
The court stated that Yu's actions did not constitute gross misconduct, and the company lacked proof of "severe losses" justifying dismissal. The judge said that rest is a fundamental labor right, urging employers to protect this right to achieve sustainable development.
