近日，上海一男子因公出差，参加英伟达活动，现场意外抽中3000元显卡，却被告知“属公司财产”要上交，相关话题在网上引发热议。

A recent incident in Shanghai in which an intern was asked to hand over a graphics card he won at a company-sponsored event has sparked widespread debate about workplace ethics.



据扬子晚报报道，小金（化名）是上海某公司的实习生，8月底刚入职。11月14日，他受公司委派前往苏州，参加一场由英伟达主办的路演活动。

现场，主办方开设了一个面向现场观众的集章抽奖活动。活动间隙，小金在去洗手间时顺便完成了盖章，“同行的同事没有去，而是把他的卡给我，让我也帮他集章。”

当天下午开奖，小金幸运地抽中了一张GeForce RTX 5060显卡，市场价值约3000元。

The intern, surnamed Jin (pseudonym), was on a business trip to a roadshow held by US semiconductor company Nvidia when he won a GeForce RTX 5060 graphics card worth about 3,000 yuan in a lottery open to all attendees.



据介绍，小金领奖后，同事先是建议他“要不卖了换钱”，但小金表示想留着组装电脑。没想到，当晚该同事给他发来消息并打来电话，称此事公司财务已知晓，“你是代表公司参加活动，出行费用由公司承担，这个显卡理应属于公司财产，下周一你把它带过来。”

After the win, a colleague informed Jin that the company considered the prize "company property", arguing that he was representing the firm during the event.

小金表示，虽然奖品价值不是特别高，但是自己中过的第一个大奖，因此非常在意，且令他感到气愤的是，感觉自己被“套路”了。

Jin, who said this was his first major prize, felt both attached to the reward and upset by what he perceived as being "set up".

小金到公司后，发现所谓的“财务已知情”并不属实。随后几天，公司高层介入后，公司为此事开了两次会商讨，并对他进行了约谈。

虽然最终没有收走显卡，但公司人事也找他谈话，委婉地表示事情闹得比较僵，建议他“找找别的公司”。小金表示，在听了人事的建议后，11月19日晚，他主动提交了离职申请。

Senior management later held two meetings about the incident and spoke with Jin directly. While the company ultimately chose not to confiscate the graphics card, the HR department reportedly suggested he "look for another company" due to the tension surrounding the matter. Jin later resigned.

是否需要“上交”？律师解读

针对小金抽中显卡被要求“充公”一事，海南昌宇律师事务所唐泰律师分析认为，界定奖品归属的关键，在于判断该奖品的获得是基于个人的“运气所得”，还是履行“职务行为”的成果。

According to lawyer Tang Tai of Hainan Changyu Law Firm, the key question is whether the intern won the graphics card through personal luck or as part of his job duties.

如果员工参与抽奖是受公司明确指派，或奖品是主办方明确赠予参会企业本身的“商务赠予”，那么该奖品可能构成公司财产。

对此，有人表示，这样的公司格局太小了。也有网友表示，既然公司承担了出差的费用，公司这样做也没毛病。还有人表示，既然财务并不知情，那就是同事关系的问题，最后公司还劝人离职，都很难评。

The case has prompted mixed reactions online. Some have argued the company had a legitimate claim since it funded the trip, but many criticized the firm for its lack of generosity and poor handling of the situation.
