“19岁女孩挪用父亲公司1700万元当‘榜一大姐’，亲爹欲带女儿自首”，4月20日，相关消息引发网友关注。



据报道，据来自河南郑州的当事人朱先生介绍，女儿小梦读了一年中专，辍学后在自家冷链档口负责出纳。

A 20-year-old woman in Zhengzhou, Henan province, was taken to the police by her father after allegedly embezzling 17 million yuan from the family's cold-chain logistics business to fund her lavish spending on livestream tipping and card-unboxing games.

The case, which has drawn widespread public attention, was reported on Monday. According to the father, surnamed Zhu, his daughter — identified by her nickname Xiaomeng — dropped out of vocational school after one year and later worked as a cashier at the family-owned company.

2024年7月，19岁的小梦开始陆续挪用档口资金在直播间打赏、购买拆卡盲盒。截至2025年11月，累计盗用、挪用1700万元，成为多个直播间“榜一大姐”。

“她在好几个直播间都是‘榜一大姐’，打赏了将近1100万。另外600多万，是玩拆卡游戏花完了。”

Between July 2024 and November 2025, Xiaomeng, who was 19 when the misconduct began, systematically misappropriated company funds. In total, she diverted 17 million yuan, becoming the top donor — known as top tipper — across several livestreaming channels.

Of the total, roughly 11 million yuan went to tipping streamers, while the remaining 6 million yuan was spent on "blind box" card-unboxing games, a popular online pastime where users purchase virtual packs for a chance to win rare digital cards.

朱先生提供的银行流水显示，2024年7月之前，小梦若干次消费，单笔数额在数十元到千元之间。7月17日开始，频繁出现单日数十次的高频率消费。其中，7月24日消费33笔，累计37278元；25日消费32笔，累计23265元；26日消费37笔，累计24117元。 截至2025年11月底，小梦基本维持着这样的频率和数额。

Bank records provided by Zhu show a sharp change in spending patterns. Before July 2024, Xiaomeng's transactions were sporadic, typically ranging from tens to a few thousand yuan. Starting July 17, she began making dozens of purchases daily. On July 24 alone, she made 33 transactions totaling 37,278 yuan; the next day, 32 transactions for 23,265 yuan; and on July 26, 37 transactions for 24,117 yuan. This pace continued until the end of November 2025.

朱先生称，小梦在某团播直播间打赏金额最多，特别是给团成员“江某某”“狐狐某某”的打赏。

Zhu said his daughter tipped most heavily on a group livestream channel, particularly two streamers identified by their online aliases.



警方已介入调查、涉事MCN回应

4月20日，河南郑州市民朱先生陪同其20岁女儿小朱，到郑州市公安局惠济分局投案。警方已介入调查。

On Monday, Zhu accompanied his daughter to the Huiji district bureau of the Zhengzhou Public Security Bureau to surrender. Police have launched an investigation.

朱先生表示，“她坐牢就是十年起，出来都30多岁了。但这1700万元是身家性命，没法跟债主交代，只有被定性为赃款才可能追回来。”

"If she's convicted, she faces at least ten years in prison — she'd be in her thirties when she gets out," Zhu told local media. "But that 17 million yuan is our family's entire livelihood. We can't explain the debt to our creditors. The only way we might recover the money is if it's legally classified as stolen funds."

据封面新闻报道，4月20日上午，记者分别联系某团播所属的MCN公司以及涉事直播平台。



MCN关联公司一名工作人员表示：“不用联系我们，直接联系平台吧。”记者再次发送短信，未获回应。

涉事直播平台表示，无法甄别消费者资金来源的性质，如果资金涉及违法行为，会依法配合相关部门的调查处理。

When contacted by a local news outlet, a staff member from the MCN company that manages the streamers declined to comment, directing inquiries to the livestream platform. The platform stated that it cannot verify the origin of users' funds but would cooperate with authorities if illegal activity is confirmed.

律师：女生无法免除刑事处罚

北京安剑律师事务所律师周兆成认为，小梦已具备完全刑事责任能力，其行为涉嫌职务侵占罪，1700万属于“数额特别巨大”，量刑为10年以上有期徒刑甚至无期徒刑；如果证明她仅是暂时挪用，有明确归还意愿，则可能涉嫌的是挪用资金罪，量刑在3到10年区间。

“即便属于近亲属间的犯罪，取得家属谅解，也仅能酌情从宽，无法免除刑事处罚。”周兆成说，这笔钱绝非“泼出去的水”，家属可以通过刑事报案和民事诉讼确权的方式维权。

周兆成认为，这1700万如果定性为赃款，获益的主播、拿分成的MCN机构、从中收取费用的直播平台，均负有返还义务。“主播需全额退还，MCN与平台如果存在未落实实名认证、未对异常大额打赏做风险提示、放任主播诱导消费等过错，还需承担连带返还责任，即便部分款项已被消费，法院也会责令退赔。”

也有律师提醒，在互联网直播行业日渐发展的当下，这样的悲剧性事件并不鲜见，这对各个家庭、直播平台以及直播从业者来说，都应该是警示。
