广西金秀瑶族自治县市场监督管理局1月6日通报：

1月6日，我局接到群众反映，广西秀瑶圣水矿泉水有限公司生产的“甲天下山歌泉”饮用天然泉水，其产品标签疑似存在违规使用人民币相关图样的问题。

我局对此高度重视，第一时间依法启动核查处置程序，迅速采集涉事产品标签样品，并送相关专业机构进行判定。目前，涉事企业已主动暂停该产品的生产与销售，积极配合监管部门开展调查工作。

下一步，我局将根据调查核实情况，严格依照法律法规作出公正处理。

The market regulator of Jinxiu Yao autonomous county in South China's Guangxi Zhuang autonomous region announced on Tuesday that it has launched an investigation into a local company over suspected improper use of Chinese currency (RMB) designs on its bottled water product labels.

The Jinxiu county market supervision administration said it acted after receiving public reports regarding the packaging of "Jiatianxia Shange Quan" natural spring water, produced by Guangxi Xiuyao Shengshui Mineral Water Co Ltd. The product label is suspected of featuring patterns that closely resemble those on the 20-yuan RMB banknote.

The administration has collected label samples for expert assessment. The involved company has voluntarily suspended production and sales of the product and is cooperating with the investigation, according to the regulator. Further action will be taken based on the investigation findings.

近日，有网友在社交媒体发帖称，广西某矿泉水包装标签上印有与20元人民币背面高度相似的图案，质疑企业违规使用人民币图样。



图片显示，一张名为“广西地方名品”“甲天下山歌泉”的矿泉水标签下部，印有与第五套人民币20元纸币背面高度相似的桂林山水图案，并在图案左下角标注“20”字样。该图案采用具有凹凸反光质感，印刷工艺讲究。

发帖网友表示：“还以为捡到钱了，这图案简直和人民币一模一样。”

The move came after social media users earlier pointed out that the water bottle's label depicted a landscape strikingly similar to the iconic Guilin scenery printed on the back of China's current 20-yuan note. The label also included a prominent reflective "20" numeral.

"Thought I'd picked up cash for a second. It looks just like the real thing," one netizen commented online.

记者对比发现，标签上的山水图案在细节上有所修改，如山峰位置有所调整，同时水波纹也进行了缩减。

该矿泉水商品条码信息显示，该产品由广西秀瑶圣水矿泉水有限公司注册。该公司成立于2012年，位于广西壮族自治区来宾市，主要从事酒、饮料和精制茶制造业。

1月5日，记者以消费者身份致电该企业。一名工作人员回应称，该产品目前仅在广西部分地区线下销售，标签图案仅为对人民币的模仿，“只是看起来像，但是实际上完全不一样”。对于标签上的“20”字样，工作人员解释称，因该产品此前售价为20元一件，故这样标注。

When contacted by a reporter posing as a consumer on Monday, a staff member of the company stated the product was only sold offline in parts of Guangxi. The staffer described the label as "just an imitation" that "looks similar but is actually not the same". The numeral "20" was added because the product was previously priced at 20 yuan per item, the employee explained.

同日，记者将此事反映至中国人民银行广西壮族自治区分行，一名货币金银处工作人员表示，分行未审批过有关矿泉水企业的人民币图样使用申请，不排除企业可能在其他省份提出申请。对于相关图案是否违反《人民币图样使用管理办法》，仍需进一步界定，有关部门将跟进研判。

《人民币图样使用管理办法》明确规定，人民币图样是指中国人民银行发行的货币的完整图案或者局部图案，禁止在祭祀用品、生活用品、票券上使用人民币图样；使用人民币图样应向中国人民银行当地分支机构进行申请。

On the same day, the reporter relayed the case to the People's Bank of China (PBOC) Guangxi Branch. An official from the bank's currency department said the branch had not approved any such usage of RMB patterns by a water company, though the firm might have applied elsewhere. The official added that determining a violation of the RMB Pattern Use Management Measures requires further review.

The PBOC regulation prohibits the use of RMB patterns on daily-use goods without prior authorization from the central bank's local branches.

福建八闽律师事务所林俊靖律师指出，若该企业被认定违规使用人民币图案，将面临警告、没收违法所得、罚款等行政处罚，得不偿失。
