近日,江苏无锡的钱先生反映,自己开车时嘴里叼了一支牙线棒,而后收到处罚单。违法行为是:“驾车时有其他妨碍安全驾驶的行为。”此事件引发热议,相关话题登上热搜。
A man surnamed Qian in Wuxi, Jiangsu province, sparked widespread online discussion after being penalized for holding a floss pick in his mouth while driving, raising a debate over whether such behavior constitutes a traffic violation.

据“问政江苏”微信公众号,钱先生称,今年8月,他驾车途中觉得无聊,便将一支牙线棒叼在嘴里,被交通摄像头拍下。随后,他就收到了相关处罚信息,认定其“驾车时有其他妨碍安全驾驶的行为”。
钱先生感到不解,从抓拍照片来看,他的驾驶姿势规范。“我双手握方向盘、目视前方,既没分散注意力,也没影响操作。”
Qian questioned the citation, noting that both his hands were on the wheel and he remained fully focused on the road.

于是,他通过交管12123APP进行申诉,得到的回复是“嘴里叼牙线如果存在分散驾驶员注意力、影响驾驶操作的行为属于妨碍安全驾驶”。

根据道路交通安全法,机动车驾驶人违反道路交通安全法律、法规关于道路通行规定的,处警告或者二十元以上二百元以下罚款。
此前有不少案例显示,驾车吸烟等明确影响安全的行为,常被认定为“妨碍安全行车行为”,予以处罚。
但钱先生表示,他不抽烟,车内也没有烟雾,钱先生希望交警部门仔细核实,撤销对其警告处罚,消除影响。
Qian appealed but was told that holding a floss pick could distract a driver and therefore counted as unsafe driving. Under China's traffic laws, such violations can result in a warning or a fine of 20 to 200 yuan, with behaviors like smoking while driving often penalized similarly. Qian, who does not smoke, asked authorities to review the case and cancel the warning.
11月12日傍晚,无锡宜兴市交管部门表示,经复核,当事人的行为未实质性影响到操作驾驶车辆,原认定确有不当。目前,已依法撤销,并对相关工作人员进行了严肃批评,同时,将进一步优化执法审核流程,提升对交通违法认定的精准性,避免类似情况再次发生。
On Wednesday, Yixing traffic authorities announced that Qian's behavior had not affected his driving. They revoked the penalty, criticized the staff involved, and pledged to improve enforcement procedures.

随后,钱先生表示,违法行为记录已撤销。他表示,“我也会吸取本次经验教训,在以后开车过程中,一定会注意驾驶安全。”
Qian later confirmed the record had been cleared, saying he had learned from the experience and would remain attentive while driving.

此事引发广泛热议。有网友认为这样的处罚太过严苛,有点“上纲上线”,也有网友持支持态度,认为“交通安全无小事”。
还有一些中立观点则认为,需要具体问题具体分析,不能一刀切地完全禁止或全部放任。


开车时叼牙线棒是否违法?
中青报·中青网记者查询发现,《中华人民共和国道路交通安全法实施条例》第六十二条中列举的驾驶机动车不得有的8类行为中,并未明确提及“叼牙线”“吃口香糖”等具体行为。
因此,在实践中,如何认定此类行为是否违法,就有不同考量。如江苏省交通事故报警热线电话的工作人员曾在受访时称,在正常驾驶的情况下,叼牙线棒不算违法。“手没离开方向盘,正常开车的话,我觉得不算违法。”
China's traffic regulations list eight prohibited behaviors — such as using a handheld phone — but do not explicitly mention holding a floss pick or chewing gum, leaving room for interpretation. A Jiangsu traffic hotline staffer said that holding a floss pick is generally not illegal if the driver keeps both hands on the wheel and drives normally.

北京市炜衡(南京)律师事务所律师吕旭辉表示,虽然《道路交通安全法实施条例》规定了驾驶机动车不得有拨打接听手持电话等妨碍安全驾驶的行为,但对于“口叼牙线”是否属于妨碍安全驾驶行为,在进行解释认定时也需考虑合理性。
“驾驶人虽叼了牙线,但双手没有离开方向盘,正常驾驶,这种情况下的危险性程度与接打电话是不具有可比性的,此时予以警告的处罚在合理性上有待商榷,缺乏对轻微违规行为的教育引导优先原则。”吕旭辉强调,该案件的处理情况也是给广大驾驶员提了个醒,警惕驾驶过程中可能妨碍驾驶安全的行为。
Lawyer Lyu Xuhui from W&H Law Firm (Nanjing) said that while regulations forbid actions that hinder driving, holding a floss pick should be judged reasonably. "If the driver's hands stay on the wheel and driving is normal, the risk is far lower than using a phone, so issuing a warning may be disproportionate," he said, adding that the case serves as a reminder to avoid even minor risky behaviors.
从安全角度出发,避免此类行为是降低风险的最佳选择。

安全无小事,但执法有尺度。这个尺度,就是要以事实为依据,以法律为准绳。
